Verizon User Generated Content Policy

You may only provide User Submissions and/or Social User Submission that you have the lawful right to provide. You are solely responsible for your User Submissions and/or Social User Submission and the consequences of creating and providing it. You represent and warrant that: (i) you are at least eighteen (18) years of age or the age of majority in your state of residence and have every right to contract in your own name in the above regard; (ii) your User Submissions and/or Social User Submission will not contain any third-party copyrighted material, or material that is subject to other third-party rights, unless you have permission from the rightful owner of the material or you are otherwise legally entitled to provide the material to Verizon and to grant Verizon the license rights granted in this UGC Agreement; (iii) your User Submissions and/or Social User Submission will not: (a) infringe, violate, or misappropriate any third-party right, including but not limited to, any copyright, trademark, patent, trade secret, moral right, privacy right, right of publicity, or any other intellectual property or proprietary right, (b) slander, defame, libel, or invade the right of privacy, publicity or other property rights of any other person, or (c) contain unlawful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, pornographic, hateful, or racially, ethnically or otherwise objectionable content; (iv) as between you and Verizon, you will be responsible for the payment of any third-party fees related to the provision and use of your User Submissions and/or Social User Submission; (v) your User Submissions and/or Social User Submission will not contain any viruses, adware, spyware, worms, or other malicious code or harmful contaminants; (vi) you waive any right to inspect or approve the User Submission and/or Social User Submission or how the User Submission and/or Social User Submission is being used and further waive any claim that you may have with respect to its use; (vii) you acknowledge that you will not receive any compensation other than any publicity that you may receive related to Verizon’s use of the User Submissions and/or Social User Submission.

We intend to make some User Submissions and/or Social User Submission public but are under no obligation to do so. You should not provide any User Submissions and/or Social User Submission that you do not wish to be visible to others.

You shall indemnify and hold harmless Verizon and its affiliates, directors, officers, employees, shareholders, licensees, and representatives from and against any and all suits, claims, demands, damages, liabilities, costs and expenses, including reasonable attorneys' fees, arising out of or related to the breach by you of the representations and warranties set forth in this UGC Agreement.

You forever release and discharge, and agree to hold harmless Verizon and its directors, officers, agents, employees, shareholders and representatives from any and all liability for any violation of any personal rights (including right of privacy and right of publicity), intellectual property rights or any other rights which you may have arising out of or in connection with Verizon’s use of the User Submission.

TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW, VERIZON IS NOT LIABLE FOR ANY DIRECT, INCIDENTAL, CONSEQUENTIAL, INDIRECT, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS ARISING OUT OF YOUR USER SUBMISSIONS EVEN IF VERIZON HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. WITHOUT LIMITING THE FOREGOING, EVERYTHING ON THE VERIZON WEB PROPERTIES IS PROVIDED TO YOU "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OR MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

Verizon does not endorse or control the User Submissions and/or Social User Submissions transmitted or posted on the Verizon Web Properties or Third-Party Sites and therefore, Verizon does not guarantee the accuracy, integrity, or quality of User Submissions. You understand that by using this, or any other Verizon Web Properties, you may be exposed to User Submissions and/or Social User Submissions that are offensive, indecent or objectionable to you. Under no circumstances will Verizon be liable in any way for any User Submissions and/or Social User Submissions, including, without limitation, for any errors or omissions in any User Submissions and/or Social User Submissions, or for any loss or damage of any kind incurred by you as a result of the use of any User Submissions and/or Social User Submissions transmitted, uploaded, posted, e-mailed, or otherwise made available via the Verizon Web Properties.

You acknowledge that Verizon has the right - though not the obligation - in our sole discretion to refuse to post or remove any User Submissions and/or Social User Submissions and it reserves the right to change, condense, edit, modify, transmit, display, or delete any User Submissions and/or Social User Submissions and you waive any right to have the material altered or changed in a manner not agreeable to you. Without limiting the generality of the foregoing or any other provision of these Agreements, Verizon has the right to remove any User Submissions and/or Social User Submission that violates this UGC Agreement or is otherwise objectionable and, solely as to the posting of content, it reserves the right to terminate access to submit User Submissions to Verizon Web Properties without prior notice for any user who violates this UGC Agreement or infringes the rights of others. Please note that any such termination will not affect your ability to make purchases, returns, or otherwise interact with the services Verizon provides.
